Terms of Service

Before making a reservation with Real Mexico Tours you should acquaint yourself with these Terms of Service. From the moment your booking request has been received, they constitute a contractual agreement between us the (OPERATOR), and you the (CLIENT).

The OPERATOR is based in Tlaquepaque, in the state of Jalisco in Mexico.  

BOOKING CONDITIONS

Tours are subject to availability and there is limited capacity. Booking requests are best submitted at least a week in advance but can also be made on short notice through this website, or via text message, email or phone. All booking requests must be approved by OPERATOR after which OPERATOR will request payment in full from CLIENT by email, and with a proforma invoice. If the Tour is not available on the requested date the CLIENT will be informed of same and can request a different date. CLIENTS should not consider their booking confirmed until they get an email confirmation from OPERATOR confirming that their payment was received. CLIENTS should print out this confirmation and bring it with them when they come for their Tour.

Tour prices do not include additional incidental fees such as taxi rides to and from Tlaquepaque, unless otherwise indicated in your email confirmation.

ACCEPTED FORMS OF PAYMENT

The OPERATOR accepts payments in cash, via Paypal and with the major credit cards displayed in this website. All payments are in US dollars.

CANCELLATIONS BY OPERATOR

The availability of the tour service may occasionally be affected by unexpected events. The OPERATOR reserves the right to cancel tours prior to their scheduled start, and will in these cases provide a full refund to the CLIENT. The refund process will be initiated within 48 hours, and the time required for the refund to be credited to the CLIENT is subject to the payment provider’s standard operating procedure.

CANCELLATIONS BY CLIENTS

CLIENTS may cancel bookings in the following conditions:
Bookings cancelled 48 hours or more before the scheduled start are entitled to a full refund.
Bookings cancelled 24-48 hours before the scheduled start are entitled to a 50% refund.
Bookings cancelled 12-24 hours before the scheduled start are entitled to a 25% refund.
Bookings cancelled less 12 hours before the scheduled start will receive no refund.
Failure by CLIENT to arrive for the tour without prior notice entitles them to no refund.

BOOKINGS BY MINORS NOT ACCEPTED

Bookings can be only be made by persons aged 18 years and older. CLIENTS booking our Services on behalf of another organization or entity agree to be bound by these Terms and Conditions and warrant that they have the authority to bind the organization or entity to this Agreement. By submitting a booking request, CLIENTS warrant and affirm that they agree to these Terms and Conditions. This Agreement is published in compliance with, and is governed by the provisions of Mexico law.

PRICE CHANGES

All rates quoted or shown in our website are current. OPERATOR reserves the right to alter or change prices on the website without notice in the event of currency fluctuation, government taxes, or any such costs increases that are outside OPERATOR’S control.

CHANGES TO ITINERARIES

OPERATOR reserves the right to alter Tour itineraries without prior notice should this be necessary due to weather, building or street renovations, or other reasons that are beyond OPERATOR’S control.

TRAVELLING WITH CHILDREN

Children under the age of 12 are not permitted to take part in or accompany travellers on our tours. A booking must be made for every child 12 years or older who will be joining their parents or guardians on one of our tours. CLIENTS warrant that they are a parent or legal guardian of any minor for whom they make a booking and who accompanies them on our tours.  

SPECIAL REQUESTS AND BESPOKE TOURS

Visitors who wish to visit attractions, businesses or destinations that are not included in our pre-planned tours should not expect any deviation from the itineraries of these tours as they are advertised in this website. Those who wish to deviate from the itineraries in our pre-planned tours should request a Bespoke Tour. The desired services should be detailed at the time of the Booking Request and will be confirmed by the OPERATOR and shown on the invoice provided when payment is made.

TRAVELLERS WITH DISABILITIES

Our tours require visitors to walk from place to place. The streets, sidewalks and attractions we navigate and visit on our tours do not all have disability access. Therefore our tours are not suitable for those with limited mobility and we do not recommend their participation. Should this recommendation be ignored we assume no responsibility for inconvenience or injury in this regard.

LOCAL PURCHASES

Unless specifically set forth in a separate contract for a Bespoke Tour, the OPERATOR does not make any gurarantees nor accept responsibility for any disatisfaction that may arise from the purchase of local handcrafts and other items such as food, furniture, jewellery, ceramics, artwork, souvenir items etc.

INSURANCE

Our pre-planned tours consist entirely of walking the streets and attractions of Tlaquepaque center, which is considered a safe and secure destination for tourists, and one that most of the time does not present any particular hazards or obstacles to visitation. The presence of police is substantial and visitors are well protected. However individual travel insurance is not included in the tour price. In the event of an injury or accident all medical and other costs assocoiated must be paid for by the CLIENT. It is strongly recommended that visitors to Mexico from abroad have personal travel insurance purchased prior to arrival, to meet any contingencies that would cover against cancellation charges, unexpected curtailment of your vacation, medical expenses arising while in Mexico that include repatriation, loss or damage to luggage, and personal liability claims against you. Should you fail to secure such Travel Insurance prior to your travel, then you accept full responsibility for yourself and all of the members of your party, and indemnify the OPERATOR and our third party travel agents and representatives (as applicable) for any and all costs that may arise, which would otherwise have been met, had such travel insurance been in force.

LIABILITY

Once a CLIENT books a tour with us they agree to be legally bound by the Terms and Conditions set forth herein. The OPERATOR acts in good faith, and when acting as an intermediary and an agent for vendors and service providers (hotel accommodation, ground transportation, meals, local insurance, etc.) is not liable for breach of contract or any intentional or careless actions or omissions on part of suppliers which may result in any loss, damage, delay, injury, death, sickness, or accident sustained by the client and his travel companions in the course of availing themselves of these services. The OPERATOR likewise shall not be responsible for any injuries, damages, losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction difficulties, diseases, local laws, climatic conditions, schedule changes caused by weather or road conditions, force majeure such as natural catastrophes, strikes, abnormal conditions or developments, or any other irregularities, actions, omissions or conditions outside the travel agent’s reasonable control. When participating in one our tours, CLIENTS voluntarily assume all risks involved with the activities, whether expected or unexpected. Unless specifically set forth in a separate contract, personal luggage and belongings, and purchases made here are carried or stored at the owners’ risk throughout the tour. Also unless specifically set forth in a separate contract, the fees for the use of any porters or transport of luggage or purchased goods must be borne by CLIENTS.

REFUSAL OF SERVICE

The OPERATOR reserves the right to refuse service to anyone. Tour participants are expected to conduct themselves in a respectful manner and to be courteous towards the tour guide, fellow participants, and the attendents and shopkeepers visited on the tour. Participants are also expected to respect the time frame in which a tour is scheduled to occur. The OPERATOR is not responsible for any delays caused by CLIENTS who stray from the tour or do not comply with the time limit the tour guide recommends for each stop or site. The OPERATOR reserves the right to leave behind any participant who strays from the itinerary, or delays or causes a disturbance to the execution of the tour.

SICKNESS OR UNWELLNESS

CLIENTS who are unwell, weak or unable to walk are responsible for evaluating the potential risks of participating in our tours. Should a CLIENT suddenly find themselves unable to continue the tour, the tour guide will do their best to organize the CLIENT’S return to their hotel or a visit to a local doctor. However the tour guide will not be obliged to stop the tour longer than it takes to arrange same.

USE OF THIRD PARTY TOUR GUIDES

The OPERATOR reserves the right to hire independent tour guides/drivers, subcontractors and/or contractors to facilitate our tours, shuttle services and travel packages.

In the event that we are unable to facilitate your Tour due to weather and/or road conditions, we will attempt to reach each location, site and destination using alternative routes but we are not liable nor responsible for unforeseen weather/traffic conditions. No refunds will be available.

TAKING AND USE OF PHOTOS AND VIDEO BY OPERATOR

Except for when taken on behalf of and for the use of participants, all photos or videos taken of tour participants by our staff or third party photographers during the conduct of the tour are the property of the OPERATOR and may be included on our website or in our marketing in all its forms. Customers hereby agree to allow the use of these photos and videos and claim no rights of use nor limitations on their use by OPERATOR.

COMPLAINTS

Our goal is to provide our Clients with excellent service. If our Clients, for any reason, are not satisfied with our service we would like to hear about it. Any request for compensation due to disatisfaction must be made within 10 days after CLIENT’s departure. Complaints and requests for compensation should be made by email to info@realmexicotours.com.

DISPUTE RESOLUTION

Any contract or dispute will be governed by and construed in accordance with Mexico Law. Both parties agree to submit to the exclusive jurisdiction of the Courts of Jalisco State, Mexico.

The effective date of this policy is shown at the top of this page. It replaces all prior privacy policies issued by the OPERATOR who reserves the right to change these terms at any time. Visitors to this website should review our policies from time to time to stay abreast of changes.
